Changes to the information available on landdirect.ie

 

As and from Friday 5 August 2011, a number of changes will be made to the information available to landdirect.ie subscribers on landdirect.ie.

 

Q1. What are the main changes ?

(i)  A search for applications on landdirect under name or folio no. will only show pending dealings - i.e. applications for registration. (This includes Land Commission Schedules). Completed dealings and copy applications (pending or completed) will not be shown on foot of a search under folio no. or name. The information given on landdirect re pending dealings will not change.

(ii) Completed dealings will only be searchable on landdirect.ie if the application number is already known to the subscriber,(i.e. usually the lodging party). The subscriber will have the relevant completed dealing number on the notice of completion issued. The information given on the landdirect.ie search re completed dealings will be limited to;

“Application D2010LR999999X was completed on……… (date). See new folios (if any) DN12345F, DN6789F”.

The same applies to dealings where the status is rejected, abandoned or withdrawn.

(iii) Applications for certified copies, pending or completed, will only be searchable on landdirect.ie if the application number is already known to the subscriber, i.e. usually the lodging party. The information given on a search under application number in landdirect re completed certified copy applications will be limited to;

“Application P2010LR999999X was completed on……… (date).

No further details will be shown.

It should be noted that when an application for a certified copy is lodged electronically (via landdirect.ie) the application number will immediately be displayed on screen and should be noted by the subscriber for future reference.

 

Q2. Why are these changes being made?

1. Under the Registration of Deeds & Title Act 1964 & 2006 and the Land Registration Rules 1972-2007, the folios of the Land Registry constitute a public register and the PRA is required by statute to put the public on notice of any applications for registration pending against a particular folio.

2. There is no statutory requirement to disclose details of other applications such as completed applications or applications for copy folio/title plans/copy instruments. As this information may comprise personal data within the meaning of the Data Protection Acts 1988 & 2003 it should not be available to all subscribers via their landdirect account. This protects the privacy of the citizen making the application. Such records are kept by the PRA only for the purpose of the administration of the subscriber’s landdirect account and the PRA's statutory functions. However, note that subscribers can check their own applications if they have the relevant application number (i.e. usually the lodging party).

 

Q. 3 Is it still possible to carry out an inspection of a folio on landdirect.ie?

Yes. The Data Protection Acts 1988 & 2003 (DP Acts) do not apply to the folios of the Register or to the abstract details, etc. on the Registry of Deeds Register which form part of the public records of the PRA. (See Section 1(4)(b) of the DP Acts). Any person can search, inspect or obtain a certified copy of a folio, on payment of the relevant fee.
